GHORER BAZAR - MASTER TERMS AND CONDITIONS OF SERVICE

SECTION 1: PREAMBLE, LEGAL BINDING, AND ACCEPTANCE

1.1. Welcome to Ghorer Bazar (hereinafter referred to as "the Platform," "Company," "We," "Us," or "Our"). This document constitutes a legally binding agreement between you (the "User," "Customer," or "Buyer") and Ghorer Bazar, governing your access to and use of our mobile application, website, digital store, and associated grocery delivery services.

1.2. By downloading, installing, registering, creating an account, browsing, or placing an order through the Ghorer Bazar platform, you explicitly acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms and Conditions in their entirety, along with our Privacy Policy.

1.3. If you do not agree to abide by every clause, condition, and provision outlined in this agreement, you must immediately cease all use of the Platform, uninstall the application, and refrain from utilizing any services offered by us.

1.4. We reserve the absolute right to modify, amend, update, add, or remove portions of these Terms and Conditions at any time at our sole discretion, without providing prior individual notice to users. The most current version will always be accessible directly within the application interface. Your continued usage of the Platform following any modifications constitutes your formal acceptance of the revised terms.

SECTION 2: SCOPE OF BUSINESS, INVENTORY, AND GEOGRAPHICAL LIMITS

2.1. Ghorer Bazar operates strictly as a proprietary local grocery retail service. We source, stock, manage, and sell our own inventory of daily essentials, food grains, edible oils, packaged snacks, and household commodities directly to retail consumers.

2.2. Unlike third-party marketplace aggregators, all goods sold on this application belong directly to us, and we act as the direct retailer and seller of record for every transaction fulfilled through the Platform.

2.3. Geographical Service Radius: To maintain freshness and quick turnaround times, our delivery services are strictly restricted to predefined operational zones (initially operating within a designated 5-kilometer radius from our core fulfillment/storage center).

2.4. We retain the unilateral right to expand, restrict, alter, or terminate delivery services in specific areas, zones, or pin codes at any given time without incurring any liability towards the user. Orders placed from outside our operational delivery zones are liable to be automatically cancelled.

SECTION 3: USER ACCOUNT REGISTRATION, SECURITY, AND OBLIGATIONS

3.1. To access ordering features, users may be required to register and maintain an active account on the Platform. This requires providing accurate, complete, and up-to-date information, including a valid and functional mobile number, accurate delivery address coordinates, and recipient details.

3.2. You are solely responsible for maintaining the strict confidentiality and security of your account credentials, login tokens, or associated devices. Any activity, order placement, or transaction executed under your account shall be deemed to have been authorized by you.

3.3. The Company shall not be held liable or responsible for any financial loss, data breach, or damages incurred as a result of unauthorized third-party access to your account due to your failure to secure your device or login information.

3.4. Users agree to use the Platform exclusively for lawful, non-commercial, personal household purposes. Any fraudulent intent, creation of fake or spam profiles, exploitation of promotional codes, denial-of-service attempts, or unauthorized data scraping will result in immediate account termination and potential legal prosecution.

SECTION 4: PRICING POLICY, PRODUCT DESCRIPTIONS, AND STOCK AVAILABILITY

4.1. All prices displayed on the Ghorer Bazar application are denoted in Indian Rupees (INR) and represent the retail price for the specified quantity. Prices may be inclusive or exclusive of applicable local taxes as specified on the product checkout window.

4.2. While we make every commercially reasonable effort to ensure that product images, weights, descriptions, pricing, and stock levels are accurate, human errors, technical glitches, printing mistakes, or system discrepancies may occasionally occur.

4.3. In the event that a product is listed at an incorrect price or shows inaccurate inventory due to a technical error, we reserve the absolute right to cancel, refuse, or adjust any such orders, regardless of whether the order has been confirmed or payment has been processed.

4.4. Product packaging, visual presentation, and manufacturer specifications may occasionally vary from what is displayed on the application due to periodic updates by manufacturers. Ghorer Bazar does not guarantee exact visual uniformity with product graphics.

SECTION 5: ORDER PLACEMENT, FULFILLMENT, AND DELIVERY PROTOCOLS

5.1. An order submitted by a customer through the app constitutes a formal offer to purchase goods. Order processing and contract formation occur only when we verify stock and dispatch the items from our facility.

5.2. Customer Delivery Responsibility: It is the absolute responsibility of the customer to provide precise, clear, and complete delivery addresses, landmarks, and reachable phone numbers. If a delivery attempt fails due to an incorrect address, locked premises, or an unresponsive customer, the delivery may be cancelled, and re-delivery charges may apply.

5.3. Delivery Timelines: Any estimated delivery timeframes (such as 120-minute express deliveries) provided on the app are approximations and general service benchmarks. Delivery schedules may experience delays due to unforeseen external factors, including heavy road traffic, adverse weather conditions, local curfews, civic disruptions, or sudden high order volumes.

5.4. The Company holds no liability whatsoever for operational delivery delays arising from circumstances beyond our direct supervision or control.

SECTION 6: RETURN, REPLACEMENT, AND REFUND POLICY

6.1. To ensure absolute transparency and customer satisfaction, Ghorer Bazar enforces a standardized 1-Day (24 Hours) Return and Replacement policy, calculated strictly from the exact date and timestamp of successful delivery.

6.2. Eligibility Parameters: Products are eligible for return or replacement exclusively under the following verified conditions:

The item delivered is physically damaged, torn, or crushed upon arrival.

The product has exceeded its printed expiration/use-by date at the time of delivery.

An incorrect product, variant, or quantity (different from what was ordered on the invoice) was delivered.

6.3. Condition of Goods: To qualify for a return, the item must remain completely unopened, unused, seal-intact, and in its original manufacturer packaging alongside the digital/physical purchase invoice. Opened, partially consumed, or tampered packaged items will strictly not be accepted for return.

6.4. Perishable & Loose Goods Inspection: Perishable items (such as fresh produce, loose grains, or unpackaged items) must be thoroughly inspected by the customer at the exact time of hand-delivery. Any complaints regarding quality or quantity of perishables must be raised immediately or within a maximum of 4 hours post-delivery; claims raised thereafter shall be deemed invalid.

6.5. Refund Processing Mechanics: Once a return request is successfully validated, investigated, and approved by our management team, corresponding refunds will be issued either via the original source of online payment or credited as wallet/store credit into the user's app account within 5 to 7 working business days.

SECTION 7: LIMITATION OF LIABILITY AND EXCLUSION OF WARRANTIES

7.1. As-Is Provision: The Ghorer Bazar platform, along with all associated software, backend infrastructure, digital menus, content, and fulfillment services, is provided on an "as-is" and "as-available" basis, without any express or implied representations or warranties of any kind.

7.2. Exemption from Technical & Telecom Failures: The Company explicitly disclaims any liability for direct, indirect, incidental, punitive, or consequential damages resulting from app crashes, server downtime, database corruption, internet service provider disruptions, telecom network failures, or cyber-attacks originating from external malicious sources.

7.3. Force Majeure Event Clause: Ghorer Bazar shall not be held legally or financially liable for any failure, hindrance, or delay in performing order fulfillments or platform operations due to events completely beyond our rational control. This includes, but is not limited to, acts of God, natural disasters, floods, earthquakes, epidemics, pandemics, government lockdowns, civil riots, strikes, labor disputes, or widespread electrical/grid blackouts.

7.4. Product Consumption Disclaimer: Customers are explicitly advised to read all product labels, ingredient details, manufacturing warnings, and storage guidelines printed on packaging prior to consumption or usage. Ghorer Bazar shall bear zero liability or legal responsibility for allergic reactions, health complications, food poisoning, or damages arising from improper storage, misuse, or mishandling of grocery items after successful delivery to the customer's premises.

SECTION 8: INTELLECTUAL PROPERTY RIGHTS AND DIGITAL ASSETS

8.1. All text, design elements, application layouts, user interfaces, source codes, graphic icons, photographs, brand names, trade logos, and specifically the trademark "Ghorer Bazar", are the exclusive intellectual property of the Company.

8.2. Unauthorized copying, downloading, digital reproduction, mirroring, reverse-engineering, modification, or commercial exploitation of any application content or database is strictly prohibited under applicable copyright and trademark laws, and violators will face immediate legal action.

SECTION 9: GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION

9.1. These Terms and Conditions, alongside any disputes or claims arising out of or connected to them, shall be governed, construed, and enforced strictly in accordance with the laws of India, without regard to conflict of law principles.

9.2. Any legal action, dispute, or proceeding arising between the User and Ghorer Bazar shall be subject to the exclusive jurisdiction of the competent local courts located within our operational district/region.
